NAAM — Terms & Policies

1. Introduction

By using NAAM’s platform (website, app, pop-up events), you agree to these Terms & Policies. If you do not agree, please do not use our services.

2. Who Can Use NAAM

  • You must be at least 18 years old or have legal capacity to enter contracts in Côte d’Ivoire.
  • You must provide accurate, up-to-date information when registering.
  • You are responsible for keeping your account credentials secure.

3. Listing & Transactions

  • You can list clothes, fabrics, accessories (e.g. dresses, handbags, shoes, jewelry).
  • Each listing must be honest, accurate, and in good condition.
  • NAAM is not the seller or buyer — you transact with other members. We are a platform facilitating swap and resale.
  • All sales, swaps, payments, or deliveries happen directly between members (except in pop-up events, where NAAM organizes the venue).

4. Fees & Payments

  • You pay a subscription or one-off fee (as per NAAM’s pricing).
  • NAAM may charge additional fees (e.g., for highlighted listings, pop-up participation, or refunds).
  • Payments between users (for sales) must use approved payment methods. NAAM may hold fees in escrow until the transaction is confirmed.
  • NAAM reserves the right to change pricing or add new fee types, with prior notice.

5. Cancellations, Returns & Disputes

  • Because items are second-hand, all sales are final unless the buyer raises a genuine discrepancy (e.g., misrepresented condition).
  • Buyers may open a dispute within a set period (e.g. 3 days after receiving item).
  • NAAM may mediate disputes but does not guarantee refunds or outcomes.
  • For event (pop-up) cancellations, NAAM’s policy applies (e.g. deadline for refunds, term for rescheduling).

6. Prohibited Items & Behavior

  • You may not list counterfeit, illegal, stolen, or hazardous items.
  • You must not harass, threaten, scam, or defraud other users.
  • No spamming, phishing, or misuse of communications tools.
  • NAAM may suspend or ban accounts that violate these rules.

7. Privacy & Data

  • We collect personal data (name, contact, photos, listings) to operate services.
  • We will protect your data and use it according to our Privacy Policy.
  • NAAM may send marketing, transactional, or service messages — you may opt out of marketing.

8. Intellectual Property

  • Listings, photos, and descriptions must be your own or permitted by you.
  • You grant NAAM a license to use your content (e.g. display photos, promotional use).
  • NAAM owns the platform, branding, code, and trademarks.

9. Liability & Disclaimers

  • NAAM provides the platform “as is” without warranties.
  • We are not liable for user-to-user transactions or disputes beyond reasonable mediation.
  • We do not guarantee any listing will sell or swap.
  • To the maximum permitted by law, NAAM’s liability is limited to amount of fees paid by the user in the past 12 months.

10. Changes & Termination

  • NAAM may modify these terms — we will notify you (e.g. via email).
  • You may terminate your account at any time (subject to outstanding transactions).
  • NAAM may suspend or terminate accounts for breaches.

11. Governing Law & Dispute Resolution

  • These Terms are governed by the laws of Côte d’Ivoire.
  • Disputes should first go through mediation by NAAM; if unresolved, parties may escalate to competent courts in Côte d’Ivoire.
